Acceptance of Terms
By accessing or using SME Construction & Maintenance H&S, you agree to be bound by these Terms & Conditions.
If you do not agree with these Terms, you must discontinue use of the App.
Purpose of the App
SME Construction & Maintenance H&S is designed to assist organizations with:
- Workforce management
- Health and safety compliance
- Worker Passport management
- Certification tracking
- Document management
- Toolbox Talk administration
- Site management
- Subcontractor management
User Accounts
Users are responsible for:
- Maintaining account security
- Protecting login credentials
- Keeping information accurate and current
- Reporting unauthorized account activity
Accounts may not be shared between individuals.
Role-Based Access
Access within the App is controlled through role-based permissions.
Users may only access information and functionality authorized for their assigned role and locations.
Attempting to access restricted information is prohibited.
Acceptable Use
Users agree not to:
- Access data without authorization
- Circumvent security measures
- Upload malicious software or content
- Interfere with system functionality
- Misrepresent identity, qualifications, or authority
- Use the App for unlawful purposes
Organization Responsibilities
Organizations using the App are responsible for:
- Maintaining accurate records
- Obtaining any necessary employee consents
- Managing user permissions appropriately
- Ensuring compliance with applicable laws and regulations
- Reviewing compliance information before making operational decisions
User Content
Organizations and users retain ownership of information and documents uploaded to the App.
By uploading content, users grant SME Construction & Maintenance H&S permission to store, process, and display that information as required to provide the service.
Intellectual Property
The App, software, branding, design, and related materials remain the property of SME Construction & Maintenance H&S and its licensors.
Users are granted a limited, non-exclusive, non-transferable license to use the App in accordance with these Terms.
Availability of Service
We strive to maintain reliable service availability but do not guarantee uninterrupted operation.
Maintenance activities, updates, outages, and circumstances beyond our control may temporarily affect access.
Limitation of Liability
To the fullest extent permitted by law:
- The App is provided on an “as available” and “as is” basis.
- We make no guarantee that the App will be error-free or uninterrupted.
- We are not liable for indirect, incidental, special, or consequential damages arising from use of the App.
- Users and organizations remain responsible for decisions made based on information contained within the App.
Suspension and Termination
Access may be suspended or terminated if:
- These Terms are violated
- Security concerns arise
- Required by law
- Requested by the subscribing organization
Changes to Terms
We may modify these Terms periodically.
Updated versions will be published with a revised effective date.
Continued use of the App following changes constitutes acceptance of the updated Terms.
Governing Law
These Terms shall be governed by and interpreted in accordance with the laws applicable in the jurisdiction in which the service provider operates.
